Reputed international divorce lawyer, Ms. Gloria James-Civetta, submitted an expert report to the trial judge on applicable Singaporean law in an expatriate divorce case. Ms James-Civetta’s argument that the two parties at no time asked to restrict the entire Singapore process was accepted by the appeals court.
Australia’s Court of Appeal ordered a new hearing to determine whether the location of an expatriate couple’s divorce hearing should be Melbourne or Singapore. The three-judge panel ruled that the Melbourne Family Court’s lead judge’s decision to hold the hearing in Melbourne was wrong.
The Australian couple got married in 2014, when they moved to Singapore. After their separation in 2016, the wife and their three children continued to live in Singapore, while the husband moved to Australia.
Ms James-Civetta, a leading expert on cross-border divorce, observed that the case “concerns where can one initiate divorce proceedings as an expatriate couple” – the place of residence in relation to the place of residence. Singapore is considering the doctrine of a more appropriate forum, while Australia considers it not to be an inappropriate forum.
